What is Murder and Attempted Murder According to South African LAW

In the South African legal system

Murder is defined as the unlawful and intentional killing of another person. Attempted murder is when someone deliberately attempts to take another person’s life but is unsuccessful in doing so.

Both serious offenses are regulated by the common law and Section 239 of the South African Criminal Law Amendment Act 105 of 1997. Murder carries a minimum sentence of 15 years and up to life imprisonment depending on the circumstances surrounding the case. Attempted murder has a minimum sentence of 5 years and up to 15 years in jail.
